The agreement

This is an agreement between you and CarpeDiem Creations LLC. If you do not accept it, do not use the service. We may update these terms; when we do, the date at the top of the page changes and continued use after that date means you accept the new version.

Who may use it

You must be at least 18 years old. Kindu Sexy contains adult content intended for consenting adults in a relationship.

What the service is

Kindu Sexy is a web application containing games, prompts, guides and trivia for couples. It is entertainment. It is not medical, psychological, therapeutic or relationship advice, and nothing in it is a substitute for a professional. Every activity it suggests is optional, and consent between you and your partner is a precondition for all of it.

Subscriptions and billing

A free tier is available with no payment method. Premium is sold as a weekly, monthly or annual subscription at the prices shown on the pricing section of this site in your currency. Subscriptions renew automatically at the end of each period until you cancel. Payment is taken by our payment processor at the start of each period.

Prices may change. If they do, the new price applies from your next renewal and never retroactively, and we tell you before that renewal.

Cancellation and refunds

You can cancel at any time from the billing portal in the app. Cancelling stops the next renewal; your access continues to the end of the period you have already paid for, and that period is not refunded pro rata. Where consumer law in your country gives you a withdrawal or refund right beyond this, that law applies and this paragraph does not limit it. If something went wrong on our side, email us.

Acceptable use

You agree not to:

• Use the service to pressure, coerce or harm another person.
• Share your access with people outside your relationship or resell it.
• Copy, scrape or redistribute the content catalogue.
• Attempt to break, overload or reverse-engineer the service.

Your content and your data

Anything you write in the app — notes, ratings, collections — is yours and stays on your device. We claim no rights over it, and because we do not receive it, we cannot restore it if you clear your browser storage. Keep that in mind before clearing site data.

Our content

The catalogue, the writing, the illustrations and the software are owned by CarpeDiem Creations LLC and licensed to you for personal, non-commercial use while your access lasts. The Kindu Sexy name and marks are ours.

Availability

We aim to keep the service running but do not promise it will be uninterrupted or error-free. We may change, suspend or discontinue features. If we discontinue a paid feature during a period you have paid for, contact us and we will make it right.

Liability

The service is provided as is. To the extent the law allows, we are not liable for indirect or consequential loss, and our total liability is limited to what you paid us in the twelve months before the claim. Nothing here excludes liability that cannot be excluded by law, including for death, personal injury caused by negligence, or fraud.

Ending access

You can stop using Kindu Sexy at any time. We may suspend or end access if these terms are broken, and where a paid period is affected and the fault is not yours, we refund the remainder.

Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. If you are a consumer in the EU or the UK, you keep the protection of the mandatory rules of your country of residence and may bring proceedings there.
